2022年11月28日-12月2日,旨在制定一项具有法律约束力的塑料污染(包括海洋环境中的塑料污染)国际文书的政府间谈判委员会(简称“INC”)第一届会议在乌拉圭埃斯特角召开,会议以线上线下结合的形式举办。亚太中心执行主任李金惠(清华大学环境学院教授)、助理主任赵娜娜作为中国代表团成员现场参会,亚太中心综合办公室主任谭全银、区域化学品管理室主任陈源作为代表团成员线上参会。亚太中心环境技术室副主任单桂娟、项目主管郝硕硕,技术助理魏凡、林微雨、王雅薇作为观察员线上参与了此次会议。亚太中心还指导清华大学环境学院沈俐伶、陈煜昊和徐玥3位本科生参会学习。本次会议是应第五届联合国环境大会通过的题为“结束塑料污染:制定具有法律约束力的国际文书”的第 5/14 号决议要求召开,来自全球160余个国家、国际组织和非政府组织的2300余名代表参加了会议。
会议主要就INC的组织安排和国际文书的内容要素两方面展开讨论。大会首先确定了政府间谈判委员会主席及8名主席团成员,基本通过了INC的议事规则。会上,各国发表了对塑料污染国际文书的设想,就文书的范围、目标、结构、核心义务、管控措施、自愿方式、国家行动计划、监测报告以及支持文书实施的能力建设、技术转移和资金机制等要素进行了初步讨论,并就文书可能包含的最终条款和委员会工作的后续安排交换了意见。经过五天的磋商,各方基本达成共识,认同国际文书将以保护人类健康和环境为目标,通过全生命周期方法治理塑料污染,并定于2023年5月22日在法国巴黎召开第二届INC会议。
11月26日-27日,会议预先组织了多利益相关方论坛和区域磋商会,分别邀请企业、行业协会、研究机构、非政府组织代表就塑料污染治理发表观点,由区域国家代表商定区域发言内容。会议还设置了两个非正式小组,分别就国际文书的潜在要素和非政府利益相关方参与文书制定进程的形式进行了深入讨论,并商定了要求秘书处在闭会期间准备的文件资料,但未能就利益相关方参与的确切方式达成共识。
在会议准备阶段和谈判过程中,亚太中心参会代表在文书范围、塑料全生命周期管理措施、化学添加剂、塑料替代、微塑料、生产者责任延伸制、国家行动计划和监测报告等子议题为中国代表团提供了有力技术支持,在大会和小组谈判中发挥了重要作用,积极捍卫了我国在谈判中的各项权益。
政府间谈判委员会(INC)是由联合国环境署(UNEP)执行主任召集、由各成员国政府代表团组成的特设机构,其职责是协商拟定多边环境协定的文本内容,并提交全权外交代表会议签署生效。
The first session of the Intergovernmental Negotiating Committee (INC) to develop a legally binding international instrument on plastic pollution, including in the marine environment, was held in Punta del Este, Uruguay, from 28 November to 2 December 2022, and was organized in a combination of online and offline formats. BCRC China Executive Director Li Jinhui (Professor, School of Environment, Tsinghua University) and Assistant Director Zhao Nana participated in the meeting on-site as members of the Chinese delegation, while Tan Quanyin, Chief of the General Office of BCRC China, and Chen Yuan, Chief of the Regional Chemicals Management Branch, participated in the meeting online as members of the delegation. BCRC China Deputy Director Shan Guijuan, Project Manager Hao Shoushuo, and Technical Assistants Wei Fan, Lin Weiyu, and Wang Yawei participated online as observers. BCRC China also guided three undergraduate students from Tsinghua University School of Environment, Shen Liling, Chen Yuhao and Xu Yue, to participate in the conference. The conference was held in response to Resolution 5/14 entitled ‘Ending Plastic Pollution: Towards an International Legally Binding Instrument’ adopted by the Fifth United Nations Environment Assembly, with more than 2,300 delegates from more than 160 countries, international organisations and non-governmental organisations (NGOs) participating in the conference.
The meeting mainly discussed the organizational arrangement of INC and the content elements of international instruments. The conference first determined the Chairman of the Intergovernmental Negotiating Committee and eight officers, and basically adopted the rules of procedure of the INC. At the meeting, countries published their vision for an international instrument on plastic pollution, and held preliminary discussions on elements such as the scope, objectives, structure, core obligations, control measures, voluntary approaches, national action plans, monitoring reports, and capacity building, technology transfer and financial mechanisms to support the implementation of the instrument. Views were exchanged on possible final provisions of the instrument and on follow-up arrangements for the work of the Commission. After five days of consultation, the parties basically reached a consensus that the international instrument will protect human health and the environment as the goal, through the whole life cycle approach to plastic pollution, and scheduled to hold the second INC meeting in Paris, France, on May 22, 2023.
From November 26 to 27, the conference organized a multi-stakeholder forum and a regional consultation in advance, inviting representatives of enterprises, industry associations, research institutions, and non-governmental organizations to express their views on plastic pollution control, and representatives of regional countries agreed on the content of regional statements. The Meeting also established two informal groups, which held in-depth discussions on the potential elements of an international instrument and the modalities for the participation of non-governmental stakeholders in the instrument development process, respectively, and agreed on documents to be prepared by the Secretariat during the intersessional period, but were unable to reach consensus on the precise modalities for stakeholder participation.
In the preparation and negotiation process of the Conference, BCRC China participants provided strong technical support to the Chinese delegation on sub-topics such as the scope of the instrument, plastic life cycle management measures, chemical additives, plastic substitution, microplastics, extended producer responsibility system, national action plans and monitoring reports, and played an important role in the conference and panel negotiations. We have actively defended our various rights and interests in the negotiations.
The Intergovernmental Negotiating Committee (INC) is an AD hoc body convened by the Executive Director of the United Nations Environment Programme (UNEP) and composed of government delegations from member countries to negotiate the text of an MEA and submit it to the Conference of Plenipotentiaries for signature and entry into force.
